General terms and conditions of business

1. Scope

These terms and conditions apply to all contracts for the rental of accommodation (holiday homes, houses, and apartments) for lodging purposes, as well as all other services and deliveries provided to the customer by Top Vermieten Betreibergesellschaft mbH (accommodation contract). The customer's terms and conditions are not accepted unless agreed upon in writing.

2. Subletting, other use

Subletting or further letting requires the company's written consent. Any other use for non-typical purposes is prohibited without permission. Events such as castings or job interviews are only permitted with consent and may incur an additional fee.

3. Conclusion of contract, contracting parties, statute of limitations

The contract is concluded upon acceptance of the application by Top Vermieten Betreibergesellschaft mbH in written form. The contracting party is the customer making the booking. The customer and the booked guest are jointly and severally liable. Claims generally expire within one year, except in cases of gross negligence, intent, or personal injury.

4. Services, prices, subsequent changes

The company provides the booked services; the customer is obligated to pay the prices valid at the time of booking. Significant changes requested by the customer require the company's approval. In such cases, the company may adjust the prices.

5. Invoices, advance payment, default, reminder fees, offsetting

Invoices are due immediately. Advance payments or security deposits may be required. Reminders incur a flat fee of €5. Offsetting is only permitted with undisputed or legally established claims.

6. Cancellation, no-show, early departure

Cancellations must be made in writing. Without explicit consent, the following conditions apply:

  • Apartments St. Marien & Altes Konsulan: 100% cancellation fee starting 1 day before arrival
  • All other accommodations: 100% cancellation fee starting 14 days before arrival
  • Non-refundable bookings: 100% from the time of booking

The company can prove higher damages. The customer is free to prove lower damages.

7. Standby period, company withdrawal

Standby periods can be agreed upon. In cases of force majeure or breaches of contract by the customer, the company may withdraw from or terminate the contract. Termination is also possible in the event of use contrary to the contract.

8. Room reservation, arrival and departure time

There is no guarantee of specific accommodations. Check-in is possible from 3:00/4:00 PM, check-out by 10:00 AM. Unvacated accommodations will be opened and luggage stored.

9. Liability

The company is liable only for gross negligence and intent, except in cases of injury to life, body, or health. Sections 701 et seq. of the German Civil Code (BGB) apply to valuables. No liability is assumed for vehicles. Left-behind items will be stored for three months.

10. Final Provisions

Amendments must be in writing. The place of jurisdiction and performance is Stralsund. German law applies. Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
